Please read these Terms of Use ("Terms of Use") carefully before using the Services offered by Sparkle Stories on Teachable.com. This agreement sets forth the legally binding terms and conditions for your use of the Sparkle Stories Course Website, owned and operated by Sparkle Stories, LCC on Teachable.com (the "Service"). By using the site or service in any manner, including but not limited to visiting or browsing the site, you agree to be bound by this agreement.

These Terms of Use apply to you if (a) you are user of the Service over the age of 18 (or, if not 18, the applicable age of majority in your jurisdiction) or (b) you are a parent or guardian entering into these Terms of Use on behalf of a child under the age of 18 who will be a user of the Service.

If you are a parent or guardian and you provide your consent to your child's registration on the site, you agree to be bound by these terms of use in respect of their use on the site.

This agreement applies to all users of the site or service, including users who are contributors of content, information, and other materials or services on the sites.

1. Terms

By accessing this School, you are agreeing to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this School are protected by applicable copyright and trademark law.

2. Use License

  1. Permission is granted to temporarily download one copy of any downloadable materials on the School’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
  2. modify or copy the materials;
  3. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  4. attempt to decompile or reverse engineer any software contained on the School’s web site;
  5. remove any copyright or other proprietary notations from the materials; or

The materials on the School’s website are provided 'as is'. The School makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, the School does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. Limitations

In no event shall the School be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the School’s website, even if the School or an authorized of the School has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

The teachers and staff of the school are not therapists and none of the content should be considered therapy or to be used in a therapeutic context. Our content has been created purely as a pedagogical curriculum drawn from the characters and narrative in the How to Be Super stories.

The School is not liable for camper's safety while performing the weekly practice. Parents and Caregivers are responsible for establishing appropriate boundaries and limitations so that the camper can recieve the full pedagogical benefit without worrying about personal safety.

5. Revisions and Errata

The materials appearing on the School’s website may include technical, typographical, or photographic errors. The School does not warrant that any of the materials on its web site are accurate, complete, or current. The School may make changes to the materials contained on its web site at any time without notice. The School does not, however, make any commitment to update the materials.

6. Links

The School has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by the School of the site. Use of any such linked website is at the user's own risk.

7. Site Terms of Use Modifications

The School may revise these Terms of Use for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these Terms of Use.

8. Governing Law

Any claim relating to the School’s website shall be governed by the laws of the School Owner’s home jurisdiction without regard to its conflict of law provisions.

9. Cancellation, Termination & Refunds

If you are unsatisfied with your course, contact us in the first 30 days after the start of the course and we will give you a full refund. It is your sole responsibility to notify us that you wish to cancel your account. This can be done by e-mailing us at howtobesuper@sparklestories.com with the subject line “Cancellation Request”. All refunds will be given to the original credit card on which the purchase was made. Please allow a reasonable time for the refund to be credited to your account.

Violation of these Terms of Use. Parents are responsible for the use of the Service by their children. Misuse of our the Service, by any individual, may result in permanent and/or temporary suspension or termination of the course account (at Sparkle Stories's sole discretion) without notice if not problems are not addressed to the satisfaction of Sparkle Stories.
